Given the laws of the European Union, with particular focus on Germany and France, some observers raise the question of whether deep security monitoring systems such as RSA® Security Analytics can be legally used. The short answer is “yes, but with due care.” This paper focuses on reviewing the use of RSA Security Analytics in Germany and France and on providing the legal framework for the “yes, but with due care” legal assessment. This legal assessment could also prove useful when considering the use of RSA Security Analytics in other countries of Europe as well.
